Electronic Communications Delivery Policy (E-SIGN Policy)
In your relationship with us, you have the option to receive certain information on paper. However, by using our services, you agree to receive this information electronically. Since our services are conducted online, you must consent to receive all necessary communications from us and our providers electronically, either through our website or via email, rather than receiving paper copies by mail.
This section outlines the technical requirements necessary for viewing, saving, or printing the communications we send. By using our service, you confirm that you have the required technology and agree to keep your contact information updated.
If you decide to stop receiving electronic communications, you may lose access to our services.
Electronic Delivery of Communications
By using our service, you consent to receive all communications, agreements, documents, notices, and disclosures ("Communications") electronically. These include important agreements and policies like the Smart Borrow Guide Terms of Service, Privacy Policy, tax statements, and product-related disclosures. Communications will be sent either by posting on the Smart Borrow Guide website or by email to the address listed in your profile.
Hardware and Software Requirements
To access and retain electronic Communications, you need the following:
- A computer with internet access
- A current web browser with 128-bit encryption and cookies enabled (e.g., Internet Explorer 11 or newer, Safari 9.0.3 or newer, Firefox v. 56 or newer, Chrome v. 60 or newer)
- Adobe Acrobat Reader 11 or newer to open .pdf files
- A valid email address
- Enough storage space to save past Communications or access to a printer to print them
By using our service, you confirm that your hardware and software meet these requirements. You also confirm that the email address you provide is accurate and capable of receiving Communications.
Additional Mobile Technology Requirements
If you access our service via a mobile device, ensure that the device can print and save Communications. If it cannot, use a device that has these capabilities.
How to Withdraw Your Consent
You may withdraw consent for receiving electronic Communications by emailing us at viktor.h@moneyguideborrow.com. If you choose to withdraw consent, we or our providers may limit, suspend, or deactivate your account, or charge fees for providing paper copies.
If you request a paper copy of any previously delivered Communication, you may do so within 180 days. These paper copies will be mailed, and you may be charged up to $5 per copy. Be sure your mailing address is up to date in your profile.
Updating Your Contact Information
You are responsible for ensuring that your email address is up-to-date to continue receiving Communications. If we send a Communication to an outdated email, it will still be considered delivered. If you use a spam filter, make sure Smart Borrow Guide is added to your contacts list to prevent missing important messages.
You can update your email or physical address by logging into your Smart Borrow Guide account and going to "Account Settings." If your email becomes invalid, your account may be marked inactive until a valid address is provided.
Responsibility for Security of Your Email Account
You authorize Smart Borrow Guide to send sensitive information, documents, and records related to your use of the service to your provided email address. You confirm that you control access to this email address and that only you or your authorized representatives have access to it. You agree to use appropriate safeguards, such as a strong password and multifactor authentication, to secure sensitive information.
If your email address changes, you are responsible for updating your profile before the change takes effect. You agree to indemnify and hold Smart Borrow Guide and its providers harmless from any claims, expenses, or damages that result from the delivery of sensitive information to your email, failure to update contact details, or violation of applicable laws or regulations.
